New rules on the use of personal data for marketing


Following a public consultation, the Committee of Advertising Practice (CAP) have now

updated the CAP Code following the introduction of new rules on the use of personal data

for marketing. The new code, which takes immediate effect, can be found via:

Marketing to corporate subscribers


One of the rules included in the new code, states that:

“10.14 Consent is not required when marketing business products by fax or by electronic

mail to corporate subscribers (see III j), including to their named employees. Marketers

must nevertheless comply with rule 10.10 and offer opt-outs in line with rule 10.6 and

10.7.”
